Self defense: When is it legal to use weapons in Nebraska while protecting yourself?

OMAHA, Neb. (FOX42KPTM) — It can happen in seconds and if it does, your only thought is likely trying to stay alive

If it ever comes down to pulling the trigger, what if you have to use a firearm to stop the threat?

Everything has to be used for lawful defense otherwise it could be seen has a deadly weapon, which would be a felony in the state of Nebraska. Pepper spray, stun guns and guns are all considered usable if deemed necessary. Trevor Thrasher with 88 Tactical said the rules for using them can change.

These are all available for use, now whether they are legal or not largely depends on whether you conceal it or what you use it for. According to self-defense laws in Nebraska, “the use of force upon or toward another person is justifiable when you believe that such force is immediately necessary for the purpose of protecting yourself if you’re defending yourself, you’re defending your life.”

Anthony Conner, President of the Omaha Police Association, said if you use a weapon you have to justify it; especially if you wind up in court.

“If you can articulate it and you can show you were defending your life, I think you’ll be okay if there was a serious threat of bodily injury or death.”

Trainers lead FOX42 through what could be life threatening situations and started with what you should do before a situation gets worse.

First, the victim should start kicking and yelling and keeping their hands up and taking a firm stance toward the attacker.

But for extra protection, the key is to always have one of the weapons in your hands in the moment you need them.

You must also keep in mind, that a stun gun or gun should only be used in life-threatening situations.

But police said there’s one step people need to take first.

“I think citizen’s have to understand there has to be some attempt to call 911 and attempt to get to a safe place,” said Anthony Conner. “If that’s possible but if it’s not possible, sometimes you may have to defend yourself.”
